Terms of Use
These Terms of Use (“Terms”) govern your use of Gather Desk, an AI-powered iOS application and related services operated by an individual developer (“Gather Desk,” “we,” “us,” or “our”).
1. Acceptance of these Terms
By downloading, accessing, or using Gather Desk, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. The service
Gather Desk helps users explore information, ask questions, summarize or understand text, and create structured next steps with AI. Features may include general AI chat, text upload or scanning, conversation history, model selection, and focused assistants such as Study Plan, Trip Planner, Fitness Plan, Chef, and Gift Ideas.
Features, supported AI models, limits, availability, and functionality may change as the service evolves.
3. AI providers and consent
Gather Desk may use third-party AI services to process your request. Before personal data or submitted content is shared with a third-party AI provider, Gather Desk presents an explicit consent flow or related disclosure identifying the relevant transfer and asking for permission where required.
If you do not grant or later withdraw the required permission, AI features that depend on that transfer may be unavailable. Please review the Privacy Policy for more information about the categories of data that may be processed.
4. AI-generated content
Gather Desk does not guarantee that AI-generated content is factual, unique, error-free, or appropriate for any particular purpose. Similar or identical outputs may be generated for other users.
5. Not professional advice
Gather Desk is a general information and productivity tool. Unless a feature explicitly states otherwise, AI output is not professional medical, mental-health, legal, financial, tax, safety, or other regulated advice. Do not use Gather Desk as a substitute for a qualified professional when professional judgment is required.
For urgent health or safety concerns, contact an appropriate emergency service or qualified professional rather than relying on an AI response.
6. Your content
You retain your rights in the prompts, text, documents, images, and other material you submit (“User Content”), subject to any rights held by third parties.
You grant us a limited, non-exclusive right to host, transmit, reproduce, process, and otherwise use User Content only as reasonably necessary to provide, secure, maintain, and support Gather Desk, including routing a request to the AI provider associated with the selected model or feature.
You represent that you have the rights and permissions needed to submit User Content and to authorize its processing under these Terms.
7. Acceptable use
You may not use Gather Desk to:
- violate applicable law or the rights of another person;
- upload content you do not have a lawful right to submit;
- attempt to compromise, probe, overload, reverse engineer, or disrupt the service or its security;
- use automated means to abuse usage limits or interfere with other users;
- distribute malware, malicious code, fraud, scams, or deceptive content;
- use the service to facilitate harmful or unlawful activity; or
- circumvent restrictions imposed by Gather Desk, Apple, or an applicable third-party AI provider.
8. Accounts, history, and access
If a version of Gather Desk provides an account, synchronization, or stored history feature, you are responsible for maintaining the security of any credentials and for activity performed through your access. We may suspend or restrict access when reasonably necessary to protect the service, users, or third parties, or to comply with law.
9. Purchases and subscriptions
If Gather Desk offers paid features, subscriptions, or in-app purchases through the App Store, billing is processed by Apple under the terms applicable to your Apple ID and App Store account. Prices, renewal terms, cancellation options, and refund rights are displayed by Apple or within the relevant purchase flow. Nothing in these Terms limits any mandatory consumer right that applies to you.
10. Intellectual property
Gather Desk, including its software, design, branding, and original service content, is protected by intellectual-property laws. Except for the limited right to use the app and service under these Terms, no rights are transferred to you.
Third-party names, model names, trademarks, and services remain the property of their respective owners. Availability of a third-party AI model through Gather Desk does not imply that the third party sponsors or endorses Gather Desk unless expressly stated.
11. Third-party services
Some features depend on third-party services, including AI model providers, infrastructure services, and Apple platform services. Your use of those services may also be subject to the applicable third party’s terms. We are not responsible for a third-party service outside our reasonable control.
12. Availability and changes
We may update, modify, suspend, limit, or discontinue part of Gather Desk when reasonably necessary for maintenance, security, legal compliance, product changes, or third-party service availability. We do not guarantee uninterrupted or error-free operation.
13. Disclaimer of warranties
To the maximum extent permitted by applicable law, Gather Desk is provided “as is” and “as available.” We disclaim warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This section does not exclude warranties or rights that cannot legally be excluded.
14. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, opportunities, or goodwill arising from or related to your use of Gather Desk. Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
15. Termination
You may stop using Gather Desk at any time. We may suspend or terminate access if you materially violate these Terms, create security or legal risk, abuse the service, or if continued access is no longer reasonably possible. Provisions that by their nature should survive termination will remain in effect.
16. Apple App Store terms
The Gather Desk iOS app is made available through Apple’s App Store. Your license to use the iOS app is also subject to Apple’s applicable App Store terms and the Apple Standard End User License Agreement, unless a valid custom EULA is separately provided through App Store Connect.
These Terms are between you and the developer of Gather Desk, not Apple. To the extent required by Apple’s terms, Apple has no obligation to provide maintenance or support for Gather Desk. Support requests should be directed to us at [email protected].
17. Applicable law and consumer rights
These Terms apply subject to the mandatory laws and consumer protections of the jurisdiction that applies to you. Nothing in these Terms is intended to waive a right that cannot legally be waived.
18. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide notice where required by law. The “Last updated” date above shows when these Terms were most recently revised.
